Amenity Usage

Children may utilize the Swim Center during the hours of 11:00 am - 1:00 pm daily if accompanied by a resident.  Children 16 years or older may utilize the Fitness Center from 1:30 pm -9:00 pm if accompanied by a resident.  Children may utilize all other amenities during normal business hours if accompanied by a resident.
Fitness classes do have a small fee for participants.  We do have punch cards, monthly passes, and annual passes.  Punch cards are available for purchase any time and are valid until completely used.  Monthly passes are available for purchase on the 15th of the month prior, and are valid for the calendar month.  Annual passes may be purchased between December 1 and January 31 of each year, and are valid for the calendar year.  Please contact our Front Desk Ambassadors at ktmc@dmbcommunitylife.com or 512-749-1250 for current pricing and assistance with online purchases.  
No.  The Welcome Center and Models are utilized for prospective residents and Kissing Tree Sales activity, and are not available for drop in usage by residents.  Occasionally, an event or activity may be scheduled utilizing one of these spaces, but these will be communicated directly from the Association for those activities.
Yes, there are locker rooms in the Fitness & Swim Centers.  There are showers in the Fitness Center locker rooms, and a rinse shower at the outdoor pool.  The Association does not provide bathing towels or toiletries.
Yes, all guests (any age) are required to be accompanied by a resident at all times while using the amenities.  Each household is limited to 6 guests without requiring written approval from the Association.  The Fitness Center guests hours are currently 1:30 p.m. - 9:00 p.m. (no guests under the age of 16 is permitted).  The Swim Center allows adult guests during operating hours, and children from 11:00 a.m. - 1:00 p.m.
Due to limited occupancy of classes, we do not permit guests to join in group fitness classes.
No, all guests must be accompanied by their sponsoring resident at all times when utilizing Kissing Tree amenities.
Yes, you may bring your own food and soft drinks to the amenities.  No outside alcohol is permitted due to restrictions relating to Texas State liquor licensing.
Pets are not permitted at Independence Hall, the Fitness Center, the Stump, the Swim Center or on the Golf Course at any time.  For ADA compliance, Trained Service Dogs may be permitted in these areas.  However, Service Dogs are permitted on the pool decks, but not in the pools.  Pets are allowed in all other areas as long as they are restrained by a physical leash under the control of a responsible person.  
Under the Community Engagement tab/drop down menu, within the Program and Event pop out click on event registration. This will take you to the KT ActiveNet page where you can search for the event you would like to attend. Follow the steps through the system and complete your registration. If you have registered for an activity or fitness class for which there is no charge, and you can’t attend, you have the ability to withdraw from the activity.  For fitness classes, please provide notification to Fitness Staff as soon as you are aware by calling 512-749-1287.  Please leave a message if you are not able to speak with staff.  For events: while in ActiveNet, go to My Account (top right on screen); Account Activity/Historical Transaction List; Select Activity from which you want to withdraw;  Actions/Withdraw: Add to Cart; Finish 
The Association permits each household to have a maximum of 6 guests at any of The Mix amenities at any one time.
Yes, you may reserve certain spaces within the amenities for private events.  Please click here for the Rental Agreement.  Contact the Front Desk at ktmc@dmbcommunitylife.com for availability of space.

The Fitness Center is open during the hours of 6:00 a.m. - 9:00 p.m. daily.  Residents will be able to access the Fitness Center during open hours.  Guests of the age of 16 or older accompanied by a resident may utilize the Fitness Center from 1:30 p.m. - 9:00 p.m. daily.
Independence Hall is open Sunday from 12:00 p.m. to 6:00 p.m., Monday thru Thursday from 8:00 a.m. to 9:00 p.m., Friday from 8:00 a.m. to 10:00 p.m., and Saturday from 10:00 a.m. to 10:00 p.m.  
The Depot at Grand Central are open Sunday from 12:00 pm to 6:00 pm, Monday thru Thursday from 8:00 am to 9:00 pm, Friday from 8:00 am to 10:00 pm, and Saturday from 10:00 am to 10:00 pm.  The Stump and the Pro Shop have seasonal hours that may change without notice.  Please contact the Pro Shop at 512-749-1031 for assistance with current hours of operation.
The Swim Center is open during the hours of 6:00 am - 9:00 pm daily.  Residents and accompanied guests of the age of 19 or older may utilize the facility during open hours.  Guests under the age of 19 accompanied by a resident may utilize the Swim Center from 11:00 am - 1:00 pm.
The next phase of The Mix is currently in development, and initial plans include a dog park, golf clubhouse, golf cart barn, and another food amenity (this isn't' fully developed, but we know it will be tasty!).  All future amenities are based on current resident interest: for example, due to resident feedback we're looking to include additional pickle ball courts.
Lane lines are in place for lap swimming at all times except during scheduled aquatics classes.  Please click here for a schedule of classes.
Punch cards and passes can be purchased through the Association's online portal for class registration.  Once purchased,  they can be picked up at the Front Desk in Independence Hall.  Please contact our Front Desk Ambassadors at ktmc@dmbcommunitylife.com or 512-749-1245 for current pricing and assistance with online purchases.  
The owner retains the rights to access the community and the unit they own, retains voting rights and remains responsible for maintenance of the home and compliance with the Governing Documents.  However, as part of the leasing requirements laid out within our documents, the homeowner transfers their rights to utilize the amenities to the tenant and will not have access to the amenities or event registration.

Community Standards

No, the Association cannot review any applications until after the home has closed.  Applications will be accepted upon notification that a home has closed.
Yes, you may attend the meeting during the time that your application is being discussed.  You may be asked to wait outside of the meeting to be called in when your application is reviewed.  Please contact our Community Operations Coordinator, Architectural at KT-ACC@dmbcommunitylife.com to request to be in attendance and obtain scheduling information.
Any structure or outbuilding on a property would need to remain within the build lines/setbacks as specified on the plat.  The exceptions are decking and overhangs, such as roofs, which can extend up to 5’ past the build line.  Landscape, including water features and yard art, and fencing can extend to the property line.

The Association will not be installing enclosures for trash bins.  If one is desired, please contact a vendor to provide a proposal and plan that can be submitted to the Association for approval.  All expenses related to the modification would be the responsibility of the homeowner.  For more information on the application process for modifications click here or email our Community Operations Coordinator at KT-ACC@dmbcommunitylife.com.
COTTAGES: Back-up generators are not permitted within the Cottage sections of the Association.  TRADITIONAL & VILLAS: Yes, generators are permitted upon approval by the Architectural Control Committee.  Please look at the Development Area Declaration for the section of the Community you live in to identify the guidelines for installation. 
Yes, all modifications to the exterior of the home must be approved by the Association.  Repairs and maintenance that will not change the aesthetic of the home, such as a roof repair with same color and type of materials or repainting the home the same color, do not require approval.  However, we do request that you notify the Association for our records and to prevent unnecessary enforcement actions.   For more information on the application process for modifications click here or email our Community Operations Coordinator at KT-ACC@dmbcommunitylife.com.
Modifications to the interior of the home do not require approval of the Association. 
COTTAGES: No modifications to the yard are permitted within the Cottage neighborhoods as the yard surrounding the homes belongs to the Association.   Replacement of dead/declining plants and seasonal plant materials will be performed by the Association.  VILLAS: Yes, all modifications to the exterior of the home must be approved by the Association.  Yard modifications within the Villa neighborhoods will be very limited as these areas are maintained by the Association.  Replacement of dead/declining plants and seasonal plant materials will be performed by the Association. TRADITIONAL: Yes, all modifications to the exterior of the home must be approved by the Association.  No modifications to the yard are permitted within the Cottage neighborhoods as the yard surrounding the homes belongs to the Association.  Replacement of dead/declining plants with the same materials, or seasonal annual replacements do not require approval.  However, we do request that you notify the Association for our records and to prevent unnecessary enforcement actions.   For any questions, email our Community Operations Coordinator at KT-ACC@dmbcommunitylife.com.
COTTAGES & VILLAS: Adding a  garden is not be permitted unless it is able to be maintained within the patio area of the home as the Association maintains all landscaping for these sections.  TRADITIONAL: A garden would be permitted upon approval of the Architectural Control Committee.  For more information on the application process for modifications click here or email our Community Operations Coordinator at KT-ACC@dmbcommunitylife.com.
COTTAGES & VILLAS: Fencing is not permitted within the Cottage sections of the Community.  TRADITIONAL: Fencing requirements vary dependent upon the neighborhood your home is located.  Please refer to the Modification Guidelines & Supplemental Guidelines found here to confirm the requirements for your home.  You may also contact KT-ACC@dmbcommunitylife.com for additional guidance.
Please note, applications for satellite dishes need to be submitted prior to installation.  The full guidelines can be found in Section 6.13 of the Modification Guidelines.  This includes the number of units permitted (one unit), the size of the unit (on meter or less in diameter or diagonal measurement), and location of installation (attached to the rear or side of the home completely below the roofline and screened from view).
TRADITIONAL: Within your private lot yes.  Please submit an application to the Architectural Control Committee for review.  If the location is within a common area of the Association, no additional furnishings or plantings may be placed without written approval of the Association.  However, we do have one exception and encourage the spreading of wild flower and native grass seeds around the ponds and within areas designed to be natural (maintained but not manicured).  Please contact our Front Desk for help identifying these locations.  COTTAGES & VILLAS: Furniture and potted plants may be placed on patios and porches of the Cottages and Villas.  However, no additions are permitted within the areas surrounding the home without written approval of the Association.  Please note, anything that is placed in the common areas of the Association will become the responsibility and property of the Association.

Finance/ Accounting

There are 3 convenient ways to pay your monthly assessments: DIRECT DEBIT - To use this convenient direct debit service, you must complete the ACH (Automated Clearing House) Direct Debit Form which can be found on the Association's website here [add link], or obtained at the Front Desk at Independence Hall.  Name, property address, signature, and bank account with routing numbers (a copy of a voided check or a screen shot of your bank account and routing numbers) is helpful to complete enrollment.  Completed enrollment forms with voided check received by the DMB Community Life (DMBCL) by the 15th of the month will be established for automatic withdraw the following month.  One enrollment form will be needed for the Master Association, and a separate form will be needed for any sub-associations you may be part of (Cottages or Villas).  Forms may be submitted via email to connect@dmbcommunitylife.com or via mail to Kissing Tree c/o DMB Community Life, [verify this is still current 4236 N Verrado Way, Suite A-201, Buckeye, AZ 85396]; AUTO BILL PAY - Recurring payments (Auto Bill Pay) must be set up through your bank's bill pay service.  To establish or continue Auto Bill Pay, you will need your account number (available on your statement from DMBCL) and the remittance address to the lock box: PO Box 64685, Phoenix, AZ 85082-4685.  Please be sure to address it to the appropriate Association (KT Master, KT Villas, or KT Cottages).  You will need to set up an auto bill pay for each entity you are a part of. ELECTRONIC CHECK & CREDIT CARD PAYMENTS - To make payments online via electronic check or credit/debit card, you can do so with Mutual of Omaha Bank (VERIFY THIS propertypay.cit.com).  If you pay with a credit or debit card, the bank will charge you a 2.95% processing fee.  It's free to use if you pay using your checking or savings account.  Please include your account number (available on your statement from DMBCL), the Management Company ID (1110) and the Association ID noted below: 2801 Kissing Tree Master Community; 2802 Kissing Tree Cottages Condominiums Association; 2803 Kissing Tree Villas Condominium Association.
The Association is currently running a deficit for operating expenses as the Association is still under development.  The Developer currently funds the budgeted deficit.  The Association budgets assessments at a level that will allow it to become self-sufficient/solvent prior to the transition of the full Board to homeowner control.  This does include minor increases to assessments annually as may be needed.
A Service Area is a specific section of the community with special maintenance needs.  The Service Area Assessment is the fee charged to the units that fall within the Service Area or who are affected by the Service Area to cover the cost of the maintenance requirements.
The Assessment is subject to change, and typically is adjusted on an annual basis.  Please contact connect@dmbcommunitylife.com for the current assessment rates.
It is a one-time fee charged at the closing of a resale home.  This fee may be used for the Association for general operations, enhancements or for funding of the Association's reserve accounts.
It is a one-time assessment charged at the closing of any home sale.  This assessment is used to assist with funding the annual operating budget and can be utilized for any necessary expense including the funding of the Association's reserve accounts.
Assessments are due on the 1st day of each month.  A late fee and interest will be charged on the 16th of the month, if the Assessment is not received and fully processed by the 15th of the month.

General

No, the Association requires all leases to be a minimum of 6 months.
The Association will maintain pest control for the common areas.  Each unit owner is responsible for pest control at their homes.

The member section of the Association website is for residents that have contracted on a lot or home, or have closed on their home.  A login can be requested by contacting our Front Desk at ktmc@dmbcommunitylife.com.
Guests under the age of 19 years old can stay within the community a maximum of 45 days in a 12 month period, and a maximum of 30 consecutive days in any single visit.  Guests age 19 or older do not have restrictions on the duration of their stay.
Each household may have 1 golf cart tag, and up to 4 tags for other vehicles.  Vehicle tags are only for residents of the community, and cannot be used for regular visitors.  The golf cart tag and the first 2 vehicle tags are free.  Additional replacement tags can be purchased.  The free golf cart tag cannot be used for other vehicles, but a vehicle tag may be used for an additional golf cart.  Please contact our Front Desk for additional assistance and costs at 512-749-1245 or ktmc@dmbcommunitylife.com.
Kissing Tree is not a Firewise Community at this time.
No, the water billing is for the water used within the residence only.  Irrigation is covered by the Association through the regular assessments.
The Master Association does not have a limit on the number of homes that can be rented at any given time.  However, the Association and Brookfield do monitor rentals within the Association.  The Villas and Cottages both have a cap on rental properties at 50% of the units able to be rentals at any given time.

The Homestead Exemption is an exemption from property taxes that can be claimed by homeowners on their primary residence. It removes part of your home’s value from taxation, lowering your taxes. For example, if your home is appraised at $350,000, and you qualify for a $25,000 exemption, you will pay taxes on the home as if it was worth only $325,000. Your primary residence is the only property that qualifies for a Homestead Exemption.
You may be entitled to a homestead exemption if you own your home on January 1 and it is your primary residence. You can claim only one homestead exemption as of January 1. In order to receive a homestead exemption, an affidavit must be filed with the Hays Central Appraisal District. All exemptions, such as homestead, over 65, disabled persons, and disabled veterans require execution of an affidavit with the Hays Central Appraisal District. You can obtain them directly from Hays Central Appraisal District at 512.268.2522 or https://www.hayscad.com/forms/.
Recreation Vehicles (RVs) can be kept within the community for a maximum of 24 hours without requiring written approval from the Association.  This is provide sufficient time for loading and unloading the vehicle.  You may request a short extension from the Associaiton based on reasonable need.  There is no street parking within the Cottages or Villas, so loading and unloading is very limited.  RVs may not be parked in The Mix parking areas overnight.
Homeowners may lease their home if so desired.  The lease of a home must be for no less than 6 consecutive months, and a copy of the lease must be provided to the Association.  There is a one-time $100.00 Tenant Set-up fee charged for each new lease (this is not charged for a lease renewal).  Please contact our Front Desk Ambassadors at ktmc@dmbcommunitylife.com or 512-749-1246 for assistance with the leasing process.  Additionally, the City of San Marcos requires each rental property within the City limits to be registered with them (City of San Marcos City Ordinance Sec. 34-821).  Click here to access the City requirements and registration page.
We welcomed our first residents in 2017, and our latest milestone was the completion of the Fitness Center and Pools in 2020.  Today, there are more than 600 homes in our active adult community, and, at completion, we estimate we'll have more than 2,800 homes! With nearly 1,200 acres of prime Hill Country land in our footprint, it may be 10 years or so until all homes are complete.

The Association currently does not have an areas, parks or amenity where pets may be off leash.  The City of San Marcos has a wonderful dog park located at 250 Charles Austin Dr, San Marcos, TX 78666 that can be utilized until such time that the Association has a dog park constructed.
TRADITIONAL: The homeowner is responsible for all landscape and irrigation at a private residence.  Please contact your landscape contractor for assistance.  VILLAS & COTTAGES: Please report concerns with landscape to our Front Desk at ktmc@dmbcommunitylife.com or 512-749-1245.  Our team will compile the information and communicate the concerns with the Association's landscape contractors.
No.  Most ponds on property are working parts of the Edwards Aquifer System.  Fishing at ponds along the golf course is prohibited due to safety issues.

Golf Club

No.  Golf course cart paths are not available for golf cart traffic outside of business hours.  
No, the Association does not permit gas powered golf carts for residents or Golf Club patrons.  This is part of the requirement for the Audubon Certification of the Kissing Tree Golf Club.  Please remember, golf carts should never be operated by individuals without a license to drive.
No, foot traffic and pets are prohibited on the golf course and cart paths at all times. 

Governance

No, board members are not and will not be compensated for their services to the Association.
COTTAGES & VILLAS: 1/3 of the Board will be elected by homeowners within 120 days of the conveyance of 50% of the lots within the sub-association to owners other than the Developer.  The full transition to homeowner control will take place within 120 days of the conveyance of 75% of the lots within the sub-association to owners other than the Developer. MASTER: 1/3 of the Board will be elected by homeowners within 120 days of the conveyance of 75% of the lots within the community to owners other than the Developer.  The full transition to homeowner control will take place at 75 years, conveyance of all lots to owners other than the Developer, or at any time that the Developer decides to transition control to the homeowners.

Maintenance

The Association does not endorse any particular vendors/contractors for private work.  Because of this, the Association does not maintain a list of vendors/contractors performing work within Kissing Tree.  We highly encourage reaching out to your neighbors to ask for recommendations, and taking the time to fully examine any contractors that you consider to perform work at your home.
COTTAGES: The walls and fencing within the Cottage areas of Kissing Tree are the responsibility of Kissing Tree Cottages Condominiums Association.  If there are concerns relating to the walls or fencing, please email KTMC@dmbcommunitylife.com  VILLAS: The walls and fencing within the Villas areas of Kissing Tree are the responsibility of Kissing Tree Villas Condominiums Association.  If there are concerns relating to the walls or fencing, please email KTMC@dmbcommunitylife.com TRADITIONAL: The walls and fencing surrounding the homes within the Traditional section of the community convey with the lot and are the responsibility of the owner of that lot.  Fencing that is wholly within the common areas of the Association, and along hole 8 of the golf course abutting the lots on Twirling Pecan, will be maintained by the Association.

Sales & Construction

Construction hours are Monday to Saturday 7:00 a.m. to 7:00 p.m.  This applies to contractors for projects at private residences as well as general construction activities within the community.
Once you've signed a contract, it can take between 9-12 months for the completion of your home.  Every home is different, and all timelines are subject to unforeseen delays, but we typically anticipate 9-10 months for Tradition Homes, 8-9 months for Cottages, and 10-11 months for Villas.

Security

The Association maintains a list of companies that provide deliveries to residents.  The guards will grant access to these companies upon their arrival.
Gate Sentry is a visitor management system the Association utilizes to enhance visitor access and privacy management for our community.  It allows our residents to have direct access to their own guest list via mobile applications and website browsers.  By linking residents directly to the gate attendants, Gate Sentry provides your guest list updates to the gate staff in real-time, ensuring they have the most up-to-date and accurate visitor information available.  Best of all, when a visitor arrives, you can receive arrival notifications in your email inbox or on your mobile device. Once you have closed on your home, an account will be set up for you to be able to add guests and vendors that can be permitted or blocked from visiting you.

Please contact our Front Desk Ambassadors at ktmc@dmbcommunitylife.com or 512-749-1246 to obtain an access tag request form.  Once completed, submit your form to the Front Desk at Independence Hall or via email.  The vehicle tags will typically be processed within 3 business days, supplies permitting.  The Association will provide 2 gate access tags for vehicles, and 1 gate access tag for a golf cart at no cost.  The golf cart tag cannot be used for a vehicle, but a vehicle tag can be used for a golf cart.  Additional tags may be requested at $50 per tag with a maximum number of 4 vehicle tags and 1 golf cart tag per home.  Replacement tags will be provided at a cost of $25 without the return of the tag to be deactivated, and at no cost with the return of the tag to be deactivated.
